1.2 "Personal Data" means data, whether true or not, about an individual who can be identified from that data, or from that data and other information to which an organization has or is likely to have access. Common examples of personal data include name, identification number, and contact information.

1.3 By using the Services, registering an account with us, visiting the Sites, and/or accessing the Services, you acknowledge and agree that you accept the practices, requirements, and/or policies set out in this Privacy Policy, and you consent to our collection, use, disclosure, and/or processing of your personal data as described in this Privacy Policy. If you do not consent to our processing of your personal data as described in this Privacy Policy, please do not use the Services or access the Sites. If we change our Privacy Policy, we will post such changes or the revised Privacy Policy on the Sites. We reserve the right to amend this Privacy Policy at any time, with or without notice to you.

2.When Does Sextoyfunny Collect Personal Data?
2.1 We will/may collect personal data about you when:
(a) You access and/or use our Services or Sites, or register and/or apply for a user account with us.
(b) You submit forms, including but not limited to application forms or other forms related to our products and services, whether online or in paper form.

(f) You carry out transactions through our Services.
(g) You provide feedback or complaints to us.
(h) You register, enter into a contract, and/or participate in competitions and/or promotional activities, including joint promotional activities with partners and/or our group companies.
(i) You use or request to use services provided by our third-party service providers on the Sites, such as payment, logistics services, etc.
(j) You visit or use the websites and applications of our partners or group companies.
(k) You visit or use third-party websites and applications that use and/or are related to our Services.
(l) You install applications on your computer, phone, or other devices ("Devices") and/or use Devices to access our Services.
(m) You connect your account with third-party websites or applications to your user account with us via the Sites, or
(n) You submit your personal data to us for any reason.
The above list is not exhaustive and merely provides common examples of when we collect personal data about you.

2.2 We may collect, use, disclose, and/or process this data for various purposes (as set out below).

2.3 Our mobile applications may collect accurate information about the location of your mobile device using technologies such as GPS, Wi-Fi, etc. We collect, use, disclose, and/or process this data for one or more purposes, including but not limited to location-based services you request or to provide you with content relevant to your location, or to allow you to share your location with other users as part of the Services under our mobile applications. For most mobile devices, you can withdraw permission for us to obtain information about your location through your device settings. If you have questions about how to disable location services on your mobile device, please contact your mobile service provider or device manufacturer.

3.What Personal Data Does Sextoyfunny Collect?
3.1 The personal data that Sextoyfunny may collect includes but is not limited to:
• Name
• Email address
• Date of birth
• Address as per ID card or passport
• Billing address
• Shipping address
• Bank account details and payment information
• Contact number
• ID card number or passport number
• Gender
• Internet Protocol (IP) address
• Any other information about the user when the user registers to use our Services or Sites, and when the user uses the Services or Sites, including information about how the user uses the Services or Sites
• The public and groups you connect or may connect with on our platform, and the nature of your communications with those persons
• Information from or about the device on which you install our applications, and/or use the device to access our Services, and/or the Sites
• Details of your account with third-party websites or applications that you have connected to your user account with us via the Sites
• Personal data you may provide to us through the Sites

3.2 As indicated in Section 2, we may receive information about you and your activities on and off the Sextoyfunny platform from our group companies and/or third-party partners, such as information from group companies and/or partners with whom we jointly offer services and/or promotional campaigns, or from advertisers about your experiences or interactions with them, including information about the websites and applications you visit, your use of our Services on those websites and applications, as well as developer or publisher information on applications or websites provided to you or us.

3.3 If you do not wish us to collect the above-mentioned data/personal data, you may withdraw your consent at any time through the Sites or by notifying our Data Protection Officer in writing. You can read more about withdrawal in the section below titled "How You Can Withdraw Consent, Request Access to, or Correct Data You Have Provided to Us". However, please remember that withdrawal of personal data collection or revocation of consent for us to collect, use, share, or process your personal data may affect your use of the Services. For example, withdrawal of location data collection will disable location-based features.

3.4 When you use a credit card to make a transaction on the Sites, you are providing your information to third-party service providers. In connection therewith, the data you have provided to the third-party service provider is subject to that third-party service provider's applicable privacy policy. Sextoyfunny does not have access to such data and does not collect your credit card details.

4.Your User Account
To use certain functions of the Services, you will need to create a user account, which will require you to submit certain personal data. When you register and create an account, we will ask you to provide your name, email address, and a username of your choice. We may also ask for some information about you, such as your phone number, email address, shipping address, identification image, bank account information, age, date of birth, gender, and any other interests. Upon activating your account, you will be able to log in under your self-created username and password, which will allow you to access and maintain your user account securely.

5.Web Browsing
When accessing most websites with your device, your device will send data which may contain your personal data, which will be recorded by the web server when you browse our web pages. This generally includes but is not limited to the IP address of your computer, operating system, browser name/version, referring web page, requested page, date/time, and sometimes "cookies" (which you can disable by adjusting your device settings) to help the Site remember your last visit. When you log in, this data will be linked to your user account. Additionally, this data will be used in anonymous statistical analysis to help us understand how visitors use our Site.

6.Cookies
6.1 We may use "cookies" or other features from time to time to help us or third parties collect or share data, to help us improve the Sites and the services we offer, or to help us offer new services and features. "Cookies" are identifiers that we send to your device to help us recognize your device and provide information about how and when you use or visit the Services or Sites, the number of users, and to track movements within our Sites. We may link cookie data with your personal data. In addition, cookies are linked to information about the items you have selected for purchase and the product lists you have viewed. For example, we use this data to track information about your shopping cart. Cookies are also used to deliver content specifically tailored to your interests and to monitor Site usage.

6.2 You may refuse the use of cookies by selecting the appropriate settings on your device. However, please remember that if you refuse the use of cookies, you may not be able to use the full functionality of the Sites or Services.

7.Viewing and Downloading Content and Advertisements
When you browse various web pages using your device, while viewing content and advertisements and using other software on our Sites or through the Services, most of the same data is sent to us (including but not limited to IP address, operating system, etc.), but instead of sending your page visits, your computer will send data about the content, advertisements viewed, and/or software installed by the Services and Sites, and the time to us.

8.Community and Support
8.1 We provide customer support through email, SMS, and feedback forms. To provide customer support, we will ask for your email address and contact number. We use only the data received from customers requesting support, including but not limited to email address, for customer support services, and we will not send or share this data with third parties.

8.2 You can also post questions and answers that other users have asked on our community forums. Our forum and messaging services allow you to participate in our community, and we will maintain data including your User ID, contact list, and status messages. In addition, such services and similar future services may require us to maintain your User ID and password.

9.Surveys
From time to time, we may request information from users through various surveys. Participation in these surveys is entirely voluntary, so you may choose whether to disclose your data to us. Requested information may include but is not limited to contact information (such as email address) and demographic information (such as interests or age range). Data obtained from these surveys will be used to review and improve service usage and satisfaction, and will not be shared with third parties except for contractors who assist us in administering and conducting the surveys.

10.How Do We Use the Data You Provide to Us?
10.1 We may collect, use, disclose, and/or process your personal data for one or more of the following purposes:
(a) To consider and/or process your submissions/transactions with us, or your transactions or communications with third parties through the Services.
(b) To manage, operate, provide, and/or administer your use of and/or access to our Services and Sites, including your relationship and user account with us.
(c) To manage, operate, administer, and provide Services to you, including facilitating the provision of our Services, including but not limited to remembering your preferences.
(d) To personalize your experience through the Services by displaying content based on your interests and preferences, and providing quick ways to access your account and send data to us, which enables us to contact you when necessary.
(e) When you use third-party applications, websites, or other services that use or integrate with our Services, that third party may receive information about what you post or share.
(f) To respond to, process, manage, or complete transactions, and/or fulfill your requests regarding products and services, and notify you of service issues and unusual account activities.
(g) To enforce our Terms of Service or applicable user license agreements.
(h) To protect the security and rights, personal property, or safety of others.
(i) For identification and/or verification purposes.
(j) To maintain and manage software updates and/or other updates, and to provide necessary support from time to time to ensure our Services run smoothly.
(k) To manage or facilitate customer service, fulfill your orders, manage or respond to inquiries received (or allegedly received) from you or on your behalf.
(l) To contact or communicate with you via voice calls, text messages, and/or fax messages, email, and/or postal mail, or in any other form, for administrative and/or relationship management purposes between you and us or your use of our Services, including but not limited to communicating management information related to our Services to you. You acknowledge and agree that such communications from us may be in the form of correspondence, documents, or notices sent to you, which may involve the disclosure of some of your personal data on the outside of the envelope/package for the purpose of delivering such items.
(m) To allow other persons to interact or connect with you on the Sites, including to notify you when other users send you private messages or post comments to you on the Sites.
(n) To conduct research, analysis, and development activities (including but not limited to data analysis, surveys, product and service development, and/or profiling), to analyze Service usage for improvement of our Services or products, and/or to enhance customer experience.
(o) To enable monitoring and conducting surveys and other activities to examine the size and composition of our target audience and understand the experiences customers have with Sextoyfunny Services.
(p) In cases where you have consented to us sending marketing and promotional information and materials related to products and/or services (including but not limited to third-party products and/or services with which Sextoyfunny may collaborate or have obligations), for marketing purposes, through various communication forms including postal mail, location-based services, or any other form, which Sextoyfunny (and/or its affiliates or related companies) may sell, market, or promote, whether such products or services exist now or will arise in the future. If you are resident in Singapore, regarding the sending of marketing or promotional information to you via voice calls, SMS/MMS, or fax to Singapore fax numbers, we will not do so unless we have complied with the requirements of the Singapore Personal Data Protection Act regarding the use of such communication forms to send such marketing information to you, or you have provided your consent.
(q) To respond to legal processes, or to comply with or act in accordance with applicable laws, government requirements, or regulations under relevant jurisdiction, including but not limited to ensuring compliance with legal disclosure requirements that Sextoyfunny or its related or affiliated companies must comply with.
(r) To prepare statistical data and research for internal and legal reporting and/or record-keeping requirements.
(s) To carry out due diligence or other screening activities (including but not limited to background checks) in accordance with legal or regulatory obligations or our risk management processes as required by law or as we have adopted.
(t) To monitor our Services or Sextoyfunny's business.
(u) To prevent and detect violations or suspected violations of our Terms of Service, fraud, illegal activities, omissions, or misconduct, whether related to your use of our Services or any other activity arising from your relationship with us.
(v) To store, host, back up (whether for disaster recovery or other purposes) your personal data, whether within or outside the jurisdiction.
(w) To manage and/or facilitate business asset transactions or potential business asset transactions in which Sextoyfunny is a participant, or solely involving Sextoyfunny's related or affiliated companies as participants, or involving Sextoyfunny and/or at least one of its related or affiliated companies as participants, and which may include external organizations as participants. "Business asset transaction" means the purchase, sale, lease, merger, consolidation, or any other acquisition, disposal, transfer, or financing of an organization or any part of an organization or its business or other assets.
(x) For the purpose of considering opening or registering an e-wallet account. E-wallet services are available within the Sextoyfunny Sites. In addition to transferring your personal data to third-party service providers and business owners to open/register an e-wallet account, maintain, operate, and provide e-wallet services to you, and for all related purposes.
(y) Any other purposes that we have notified you of at the time of obtaining your consent.
(Collectively referred to as the "Purposes")

10.2 You acknowledge, consent, and agree that Sextoyfunny may access, preserve, and disclose data in your user account, including "Content", if required to do so by law, or pursuant to a court order, or an order from any governmental authority having jurisdiction over Sextoyfunny, or if we believe in good faith that such action is necessary to: (a) comply with any legal process; (b) comply with any order from any governmental authority having jurisdiction over Sextoyfunny; (c) enforce our Terms of Service and this Privacy Policy; (d) respond to any claims, whether threatened or actual, against Sextoyfunny or any claims arising from the "Content" infringing upon any rights of others; (e) respond to your requests for customer service; or (f) protect the rights, property security, and personal safety of Sextoyfunny, its users, and/or the public.

10.3 Because the purposes for which we will collect, use, disclose, and/or process your personal data depend on the specific circumstances at hand, such purposes may not appear in the above list. However, we will notify you of such purposes at the time we seek your consent, unless the relevant processing of data without your consent is permitted under the Data Protection Laws.

11.Sharing of Data from the Services
Our Services allow users to share personal data with others for transactions in almost all situations, without Sextoyfunny being involved in any way. In typical transactions, users may access each other's names, user IDs, email addresses, and contact and mailing information. Our Terms of Service require that users who possess personal data of another user (the "Receiving Party") shall: (i) comply with all applicable Data Protection Laws; (ii) allow the other user (the "Disclosing Party") to remove themselves from the Receiving Party's database; and (iii) allow the Disclosing Party to review what data the Receiving Party has collected about them.

12.How Does Sextoyfunny Protect and Retain Customer Personal Data?
12.1 We implement various security measures with our best efforts to ensure that your personal data within our systems is secure. User personal data is stored on secure networks and accessible only to a limited number of employees who have special access rights to such systems. However, we cannot guarantee the complete security of your personal data.

12.2 We will retain your personal data in accordance with the Data Protection Laws and/or other applicable laws. We will destroy or anonymize your personal data as soon as it is reasonable to believe that: (i) the purpose for which the personal data was collected is no longer served by retaining such personal data; (ii) retention is no longer necessary for legal or business purposes; and (iii) there is no other legitimate interest in retaining such personal data. If you cease using the Sites, or your license to use the Sites and/or Services is revoked or terminated, we may continue to store, use, and/or disclose your personal data in accordance with the Data Protection Laws and our obligations under this Privacy Policy. Under applicable law, we may securely destroy your personal data without prior notice.

13.Does Sextoyfunny Disclose Data Collected from Visitors to Third Parties?
13.1 In the conduct of our business, we may need to disclose your personal data to third-party service providers, agents, and/or our affiliates or related companies, and/or other third parties, whether located within or outside Singapore, for one or more of the Purposes set out above. Such third-party service providers, agents, and/or our affiliates or related companies, and/or other third parties may process your personal data on our behalf or otherwise for one or more of the Purposes set out above. Such third parties include but are not limited to:
(a) Our affiliates, group companies, and related companies.
(b) Other users of the Sites for one or more Purposes.
(c) Contractors, agents, service providers, and other third parties that we use to support our business. These include but are not limited to administrative or other service providers, such as postal/courier companies, telecommunications companies, information technology service providers, and data centers.
(d) Purchasers, transferees, or successors in the event of a merger, divestiture, restructuring, reorganization, liquidation, or sale or transfer of some or all of Sextoyfunny's assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceedings, in which personal data about our users held by Sextoyfunny is among the assets transferred.
(e) Counterparties in business asset transactions in which Sextoyfunny or our affiliates or related companies are involved; and/or
(f) Third parties to whom we have disclosed data for one or more Purposes, and such third parties may collect and process your personal data for one or more Purposes.

13.2 We may need to share statistical and demographic data about users and their use of our Services with advertisers and programmers.

13.3 For the avoidance of doubt, in cases where the Data Protection Laws or other applicable laws permit an organization such as ours to collect, use, or disclose your personal data without your consent, such legal permission shall continue to apply.

13.4 Third parties may unlawfully intercept or access personal data transmitted to or contained on the Sites. Technologies may malfunction or not function as expected, or someone may access, use, or misuse data inappropriately, without any fault on our part. Nevertheless, we will implement reasonable security measures to protect your personal data as required under the Data Protection Laws. However, we cannot guarantee complete security in cases of unavoidable incidents, including but not limited to unauthorized disclosure resulting from sophisticated malicious data breaches by dissatisfied parties, without any fault on our part.

13.5 Sextoyfunny allows you to share videos from YouTube in the Sextoyfunny Livestream feature ("YouTube Content"). For such purposes, Sextoyfunny uses the YouTube API Services provided by YouTube. By sharing YouTube Content, you agree to be bound by the YouTube Terms of Service (https://developers.google.com/youtube/terms/api-services-terms-of-service) and the Google Privacy Policy (http://www.google.com/policies/privacy).

14.Age Description
The Services are not intended for children under 18 years of age. We do not knowingly collect or retain any personal data or non-personal data that can identify an individual under 18 years of age, nor do we intentionally provide any part of our Sites or other Services to children under 18 years of age. We request that parents or legal guardians supervise and ensure that children under their care do not submit personal data to Sextoyfunny. However, if personal data of a child under 18 years of age under your care is submitted to Sextoyfunny, you are deemed to have consented to our possession of that personal data, and you accept and agree to be bound by the terms of this Privacy Policy on behalf of that child. Nevertheless, we will close accounts used by children and will withdraw and/or delete any personal data that we believe was submitted from a child under 18 years of age without parental or legal guardian consent.

15.Data Collected by Third Parties
15.1 Our Sites use Google Analytics, a web analytics service provided by Google, Inc. ("Google"). Google Analytics uses cookies, which are text files stored on your computer to help the website analyze how users use the site. The data generated by the cookie about your use of the website (including your IP address) will be transmitted to and stored by Google on servers in the United States. Google will use this data to evaluate your use of the website, compile reports on website activity for website operators, and provide other services relating to website activity and internet usage. Google may also transfer this data to third parties where required to do so by law, or where such third parties process the data on Google's behalf. Google will not associate your IP address with any other data held by Google.

15.2 We and third parties may from time to time provide software application downloads to allow you to use or access the Services. These applications may access separately and allow third parties to view your identifiable data, including your name, user ID, and computer IP address, or any other data such as cookies that you may have previously installed, or that third-party applications or websites have installed for you. In addition, these applications may request that you provide additional data directly to third parties. Products or services of third parties provided through these applications are not products or services of Sextoyfunny, nor are they controlled by Sextoyfunny. We recommend that you read the terms and policies published by such third parties on their websites or other sites.

16.Disclaimer of Security and Third-Party Sites
16.1 We do not guarantee that personal data and/or other data you provide to third-party sites will be secure. We implement various security measures to maintain the security of your personal data in our possession or control. User personal data is stored on secure networks and accessible only to a limited number of employees who have special access rights to such systems and are required to keep personal data confidential. When you place an order or access your personal data, we offer the use of a secure server. All personal data or sensitive data you provide will be encrypted in our database to be accessible only as specified above.

16.2 In an effort to enhance your benefit, we may select various third-party websites to link to or be embedded within the Sites. We may also engage in co-branding or other relationships to offer e-commerce transactions and/or other services and features to visitors. These linked sites will have separate and independent privacy policies and security management. Even though third parties may have relationships with us, we have no control over these linked sites, as each site has independent privacy and data collection practices separate from ours. Data collected from co-branded partners with us or third-party websites (even if presented on or through our Sites) may not be received by us.

16.3 Therefore, we are not responsible or liable for the content, security management (or lack of security), and activities of these linked sites. These linked sites are provided for your convenience and you access them at your own risk. However, we wish to protect the integrity of the Sites and the links contained on each of our Sites, and welcome feedback regarding these linked sites (including but not limited to if a specific link is not working).

17.Will Sextoyfunny Transfer Your Data Overseas?
Your personal data and/or data may be transferred, stored, and processed. Sextoyfunny will transfer your data overseas only in accordance with the Data Protection Laws.

18.How You Can Withdraw Consent, Request Access to, or Correct Data You Have Provided to Us
18.1 Withdrawal of Consent
18.1.1 If you wish to change or cancel your email subscription, please notify us by emailing our Data Protection Officer at the address provided below. Please remember that due to our email scheduling, you may still receive emails that are already in production.
18.1.2 You may withdraw your consent for the collection, use, and/or disclosure of your personal data in our possession or control by emailing our Data Protection Officer at the email address provided in Section 19.2 below.
18.1.3 If you have shared YouTube Content, in addition to withdrawing your consent by email as set out in Section 18.1.2, you may revoke Sextoyfunny's access to your personal data through the Google security settings page at https://security.google.com/settings/security/permissions.
18.1.4 Upon receiving your clear written instruction and verifying your identity, we will process your request for withdrawal of consent in accordance with the terms set out in this Privacy Policy and the Data Protection Laws and other applicable laws, and thereafter we will no longer collect, use, and/or disclose your personal data in the manner specified in your request. If we are unable to verify your identity or understand your instruction, we will contact you for clarification regarding your request.
18.1.5 However, withdrawal of consent may result in consequences arising from such withdrawal. In this regard, depending on the scope of withdrawal of consent for us to process your personal data, it may mean that we are unable to continue providing Services to you. We may therefore need to terminate our existing relationship and/or contracts you have with us, etc., as the case may be, of which we will notify you.

18.2 Request for Access and/or Correction of Personal Data
18.2.1 If you have an account with us, you may personally access and/or correct your personal data in our possession or control through the account settings page on the Sites. If you do not have an account with us, we do not hold your personal data.
18.2.2 For requests to access personal data, once we have sufficient information to proceed, we will provide you with the relevant personal data within 30 days (or 21 days if you reside in Malaysia). If we are unable to respond to your request within such 30 days (or 21 days if you reside in Malaysia), we will notify you of the earliest possible time when we can provide the data you requested. Please remember that the Data Protection Laws may exempt certain types of personal data from your access request.
18.2.3 For requests to correct personal data, once we have sufficient information to proceed, we will:
(a) Correct your personal data within 30 days (or 21 days if you reside in Malaysia). If we are unable to make the correction within such period, we will notify you of the earliest possible time for the correction. Please remember that the Data Protection Laws may exempt certain types of personal data from correction requests, and may stipulate the time required for us to make corrections in certain circumstances, even if you have made a request; and
(b) We will send the corrected personal data to every organization to which we disclosed the personal data within one year prior to the date of correction, unless that organization does not need the corrected personal data for legal or business purposes.
18.2.4 Notwithstanding sub-paragraph (b) above, if you request, we may send the corrected personal data to a specific organization to which we disclosed the personal data within one year prior to the date of correction.
18.2.5 To the extent permitted by law, we may charge a reasonable fee for processing and handling your request for access to personal data. If we choose to charge a fee, we will provide you with a written estimate of the fee. Please remember that we are not required to respond to or act on your access request unless you agree to pay the fee.
18.2.6 We reserve the right to refuse correction of your personal data in accordance with the provisions set out in the Data Protection Laws, which stipulate and/or grant organizations the right to refuse correction of personal data in specified circumstances.
